7.1.1BoxBox operates solely as a technology platform facilitating interactions between Users and Garages.
7.1.2Except where expressly stated otherwise:

(a)inspect any Vehicle;

(d)selecting replacement parts;
(e)complying with applicable laws;
(f)maintaining licences;
(g)honouring warranties.
7.2.2Users remain responsible for deciding whether to engage a Garage.

(a)Vehicle details;
(b)mileage;
(c)fault descriptions;
(d)photographs;
(e)videos;
(f)previous repair history where relevant.
8.2.1Users acknowledge that quotations prepared using incomplete or inaccurate information may require revision following inspection.
8.2.2Submission of a quotation request does not create any obligation on either party to proceed with the proposed work.
9.1.1Quotations are prepared solely by the relevant Garage.
9.1.2A quotation may include:
(a)labour charges;
(b)replacement parts;
(c)consumables;
(d)taxes;
(e)diagnostic fees;
(f)estimated completion times;
(g)warranties offered by the Garage.
9.2.1Unless expressly stated otherwise:
(a)quotations are estimates only;

(d)BoxBox does not verify the commercial accuracy of quotations before they are displayed.
9.2.2The Garage is responsible for communicating any revised quotation before carrying out additional chargeable work, except where emergency action is reasonably necessary to protect the Vehicle or comply with applicable law.
10.1.1Where a User accepts a quotation, the Platform may facilitate the booking of automotive services.
10.1.2Booking confirmation does not create a contract between the User and BoxBox for the repair services. A contract between the User and Garage for the Garage Services is formed when the User accepts the relevant Quote through the Platform and the Platform confirms that acceptance, unless the Quote expressly states that further Garage confirmation is required.
10.1.3The repair contract exists solely between the User and the selected Garage.
10.2.1Users should carefully review:
(a)pricing;
(b)service descriptions;
(c)completion estimates;
(d)warranties;
(e)cancellation terms; and
(f)any additional conditions provided by the Garage before confirming a booking.
11.1.1The Platform may facilitate payments through authorised third-party payment providers.
11.1.2Depending on the services offered, payments may include:
(a)Authorization with delayed capture;
(b)deposits;

(g)refunds.
11.2.1BoxBox may collect platform fees, commissions or service charges as disclosed during the booking process.
11.2.2Payments for Garage Services are processed by a third-party payment service provider authorised to provide the relevant payment services in the UAE. Except to the extent expressly permitted by applicable law, BoxBox does not hold customer funds or provide regulated payment services.
11.2.3Failure to complete payment may result in cancellation of the booking or suspension of access to certain Platform features.
11.3.1Any instalment, credit or buy-now-pay-later arrangement is provided under a separate agreement between the User and the relevant authorised finance provider. BoxBox is not the lender and does not determine credit approval.
12.1.1A User may cancel or reschedule a Booking through the Platform, subject to any cancellation terms displayed at the time of Booking.
12.1.2Depending on the circumstances, cancellation charges may apply where:
(a)the Garage has already commenced work;
(b)parts have been ordered specifically for the Vehicle;
(c)recovery or transportation has already been dispatched;
(d)diagnostic work has been performed;
(e)the cancellation occurs within a specified period before the scheduled appointment; or
(f)the Garage has otherwise incurred reasonable costs in reliance on the Booking.
12.1.3Any cancellation charge must be clearly disclosed to the User before the Booking is confirmed and must be reasonable and proportionate to the circumstances giving rise to the charge.
12.2.1A Garage may cancel a Booking where reasonably necessary, including because of:
(a)equipment failure;
(b)technician unavailability;
(c)parts unavailability;
(d)incorrect Vehicle information;
(e)safety concerns;
(f)inability to perform the requested work; or
(g)circumstances outside the Garage's reasonable control.
12.2.2Where a Garage cancels before the relevant services are provided, the User will receive a refund of amounts paid for services not provided, subject only to deductions expressly permitted by applicable law and clearly disclosed before Booking.
12.2.3BoxBox may assist the User in identifying an alternative Garage but does not guarantee that an alternative Garage will be available.
12.3.1Where a refund is due, BoxBox or the applicable payment provider may process the refund to the original payment method.
12.3.2Refund processing times may depend upon the relevant bank, card issuer, payment provider or other financial institution.
12.3.3A refund processed through the Platform does not necessarily constitute an admission of liability by BoxBox or the Garage.
12.4.1Users should raise disputed charges through the Platform as soon as reasonably practicable.
12.4.2BoxBox may request supporting information from the User and Garage and may facilitate communication between them.
12.4.3Unless expressly stated otherwise, BoxBox does not act as an arbitrator and is not required to determine the legal merits of disputes between Users and Garages.
13.1.1Users acknowledge that certain automotive faults cannot reasonably be diagnosed without physically inspecting, testing or dismantling parts of a Vehicle.
13.1.2Accordingly, a Quote provided before inspection may be preliminary.
13.2.1A Garage may recommend diagnostic work before providing a final quotation.
13.2.2Where a diagnostic charge applies, that charge should be disclosed to the User before the diagnostic work is undertaken.
13.3.1If a Garage identifies additional work after inspecting the Vehicle, it should provide the User with details of:
(a)the additional work recommended;
(b)the reason the work is recommended;
(c)the additional price; and
(d)any material impact on the expected completion time.
13.3.2A Garage must not undertake additional chargeable work that was not included in the accepted Quote unless the User has expressly approved the additional work and price through the Platform or another recorded communication method.
13.4.1A Garage may identify issues that it considers unsafe or likely to make the Vehicle unroadworthy.
13.4.2The Garage may recommend that the Vehicle not be driven until the relevant issue is addressed.
13.4.3Any such recommendation is made by the Garage, not BoxBox.
14.1.1Garages may use:
(a)original equipment manufacturer parts;
(b)original equipment equivalent parts;
(c)aftermarket parts;
(d)refurbished or reconditioned parts; or
(e)used parts,
where appropriate and where agreed with the User.
14.2.1The Garage is responsible for accurately describing the type of parts included within its Quote.
14.2.2Unless expressly identified otherwise, automotive parts are selected and supplied by the relevant Garage and not by BoxBox. The Garage remains responsible for its obligations relating to those parts, without prejudice to any responsibility imposed directly on BoxBox by applicable law.
14.2.3Any manufacturer's warranty or Garage warranty applicable to a part is subject to the terms imposed by the relevant manufacturer, distributor or Garage.
15.1.1Garages are responsible for all warranties, remedies and service-quality obligations imposed on them by applicable law. A Garage may also offer additional contractual warranties covering workmanship, parts or both..
15.1.2Where applicable, warranty information may be displayed through the Platform.
15.2.1Unless expressly identified as a BoxBox warranty, any such warranty is provided solely by the Garage or relevant parts manufacturer.
15.2.2BoxBox does not assume responsibility for a Garage's warranty obligations merely because information concerning that warranty appears on the Platform.
15.2.3Nothing in these Terms excludes any statutory warranty, guarantee or consumer right that cannot lawfully be excluded.
16.1.1The Platform may enable Users to arrange the collection, transportation and delivery of Vehicles to and from participating Garages ("Transportation Services").
16.1.2Transportation Services may be performed through:
(a)vehicle transportation using a recovery truck, flatbed truck or other suitable vehicle transporter ("Transporter Services"); or
(b)collection and delivery by a suitably qualified and licensed driver operating the User's Vehicle ("Driver Collection Services").
16.1.3Unless expressly made available through the Platform, Transportation Services do not include emergency roadside assistance, breakdown attendance or accident recovery.
16.2.1Transportation Services are performed by independent third-party service providers ("Transportation Providers"), which may include their authorised service providers for Driver Collection Services.
16.2.2The identity of the applicable Transportation Provider, the nature of the Transportation Services, applicable charges and any material service-specific conditions will be disclosed before the relevant Booking is confirmed.
16.2.3Unless expressly agreed otherwise, BoxBox acts as an intermediary arranging Transportation Services and does not itself operate transportation vehicles or employ drivers to perform those services.
16.2.4Nothing in this Section excludes any duty or liability imposed directly upon BoxBox by applicable law.
16.3.1By confirming a Transportation Services Booking, the User represents that they own the Vehicle or have the necessary authority to arrange its collection, transportation, delivery and release to the relevant Garage.
16.3.2The User authorises the relevant Transportation Provider and its properly authorised personnel to take possession of the Vehicle and its keys, transport or drive it as necessary to perform the requested service, and deliver it to the designated recipient.
16.4.1The User must disclose accurate information regarding the Vehicle's location, condition, dimensions, modifications, mobility, mechanical defects and any circumstances that may affect safe collection or transportation.
16.4.2Driver Collection Services are available only where the Vehicle is roadworthy, lawfully registered and appropriately insured for operation by the designated driver.
16.4.3The User must ensure that any permissions required under the relevant motor insurance policy are in place.
16.4.4A Transportation Provider may refuse to collect or drive a Vehicle where it reasonably determines that collection or transportation would be unsafe, unlawful or unsuitable.
16.5.1Transportation Providers may inspect and photograph a Vehicle at collection and delivery and record its visible condition, odometer reading and other relevant information.
16.5.2The User agrees that such records may be retained and shared with BoxBox, the relevant Garage and insurers where reasonably necessary to administer the service, investigate incidents or resolve disputes, in accordance with applicable data protection law.
16.6.1Transportation charges, cancellation fees, waiting charges and other applicable fees will be disclosed before Booking confirmation or, where additional circumstances arise, before the relevant additional charge is incurred wherever reasonably practicable.
16.6.2Any cancellation or additional charges must be reasonable, properly disclosed and consistent with applicable law.
16.7.1Transportation Providers are responsible for performing their services with the care and skill required by applicable law and their contractual obligations.
16.7.2Where loss, theft, damage or an accident occurs during Transportation Services, the User should notify BoxBox and the relevant Transportation Provider as soon as reasonably practicable and provide available supporting information.
16.7.3BoxBox may assist in investigating the matter and facilitating communication, incident reporting and applicable insurance claims.
16.7.4The extent of insurance coverage, any applicable policy excess and the respective responsibilities of the parties may depend upon the circumstances, the applicable insurance policy and mandatory law.
16.7.5Nothing in these Terms excludes or restricts liability for loss or damage where such exclusion or restriction is prohibited by applicable law.
16.8.1Users should remove valuables, cash and unnecessary personal possessions before releasing a Vehicle for Transportation Services.
16.8.2Responsibility for loss of personal property will be determined under applicable law and the circumstances of the relevant incident.
16.9.1Transportation Services may be subject to additional conditions imposed by the relevant Transportation Provider, provided those conditions are disclosed and incorporated into the Booking where required by applicable law.
16.9.2If any additional conditions conflict with mandatory consumer protections or obligations expressly assumed by BoxBox, those protections and obligations will prevail.
17.1.1BoxBox may display information concerning Garages including:
(a)location;
(b)photographs;
(c)operating hours;
(d)services offered;
(e)pricing;
(f)certifications;
(g)technician qualifications;
(h)facilities;

(k)recovery capability;
(l)customer reviews;
(m)ratings; and
(n)BoxBox verification status.
17.2.1BoxBox may undertake verification procedures before or after permitting a Garage to participate on the Platform.
17.2.2These procedures may include:
(a)trade licence checks;
(b)document verification;
(c)physical site inspections;
(d)insurance verification;
(e)technician qualification checks;
(f)equipment inspections; and
(g)ongoing quality monitoring.
17.2.3Verification indicates only that the Garage satisfied the relevant BoxBox verification requirements at the time the verification was performed.
17.2.4Verification does not constitute a guarantee that:
(a)every statement made by the Garage is accurate;
(b)every technician is appropriately qualified for every repair;
(c)the Garage will continuously satisfy verification criteria;
(d)any particular repair will be performed correctly; or
(e)the User will be satisfied with the Garage's services.
17.2.5Users should exercise reasonable judgment when selecting a Garage.
18.1.1BoxBox may determine the order in which Garages appear in search results.
18.1.2Search rankings may take account of factors including:
(a)geographic proximity;
(b)service availability;
(c)Vehicle specialisation;
(d)customer ratings;
(e)historical service quality;
(f)response times;
(g)pricing;
(h)estimated completion times;
(i)cancellation rates;
(j)complaint history;
(k)verification status;
(l)Platform activity; and
(m)other quality or relevance indicators.
18.2.1BoxBox may change its ranking methodology from time to time.
18.2.2Where a Garage has paid for enhanced visibility or sponsored placement, such paid or sponsored placement will be clearly identified as such.
19.1.1Users may be invited to rate or review a Garage following a Booking.
19.1.2Reviews should reflect the User's genuine experience.
19.1.3Users must not submit reviews that are:
(a)false or misleading;
(b)defamatory;
(c)threatening;
(d)discriminatory;
(e)obscene;
(f)fraudulent;
(g)unrelated to the relevant service; or
(h)intended primarily to manipulate a Garage's rating.
19.2.1BoxBox may moderate, investigate, remove or decline to publish reviews where reasonably necessary to:
(a)enforce these Terms;
(b)prevent fraud;
(c)comply with law;
(d)protect users;
(e)remove abusive content; or
(f)maintain the integrity of the review system.
19.2.2BoxBox is not required to remove a negative review merely because a Garage disputes it.
19.3.1Garage ratings may be based upon multiple factors and need not represent a simple arithmetic average of individual reviews.
19.3.2BoxBox may consider factors including:
(a)recency;
(b)verified transactions;
(c)number of completed Bookings;
(d)reliability;
(e)complaint history; and
(f)suspected manipulation.
19.4.1Users and Garages must not:
(a)purchase reviews;
(b)submit fake reviews;
(c)offer improper incentives for positive reviews;
(d)create accounts for the purpose of manipulating ratings; or
(e)coordinate review manipulation.
19.4.2BoxBox may suspend Accounts or Garage listings where it reasonably suspects such activity.
20.1.1BoxBox may display proprietary scores, badges or indicators intended to help Users compare Garages.
20.1.2These may include indicators relating to:
(a)service quality;
(b)value;
(c)speed;
(d)reliability;
(e)customer satisfaction;
(f)response time;
(g)specialist capabilities; and
(h)verification status.
20.1.3Such indicators may be generated using algorithms, customer feedback, operational data and other information available to BoxBox.
20.2.1They represent BoxBox's assessment based on available information and should not be interpreted as guarantees of future performance.
20.2.2BoxBox may modify its scoring methodology at any time to improve accuracy, reliability or usefulness.
21.1.1The Platform may include features powered wholly or partly by artificial intelligence, machine learning or automated decision-support technologies ("AI Features").
21.1.2AI Features may assist Users with:
(a)understanding automotive terminology;
(b)summarising Garage Quotes;
(c)comparing Quotes;
(d)identifying differences between proposed repairs;
(e)explaining potential repairs;
(f)identifying potentially missing information;
(g)identifying unusual pricing;
(h)estimating indicative market pricing;
(i)categorising Vehicle problems;
(j)suggesting appropriate services;
(k)recommending Garages; and
(l)answering questions regarding automotive maintenance.
21.2.1AI-generated information is provided for informational and decision-support purposes only.
21.2.2It does not constitute:
(a)professional mechanical advice;
(b)a Vehicle diagnosis;
(c)an engineering assessment;
(d)a safety inspection;
(e)a warranty;
(f)a valuation; or
(g)a guarantee that any Garage recommendation or Quote is appropriate.
21.3.1Users acknowledge that AI systems may:
(a)generate inaccurate information;
(b)misunderstand Vehicle symptoms;
(c)omit relevant information;
(d)rely upon incomplete data;
(e)produce outdated information; or
(f)reach different conclusions from a qualified technician.
21.3.2Users should consider AI outputs alongside information provided by appropriately qualified automotive professionals.
21.4.1Where BoxBox analyses a Garage Quote, the analysis may be based on factors including:
(a)Vehicle make and model;
(b)Vehicle age;
(c)mileage;
(d)service type;
(e)parts prices;
(f)historical Platform transactions;
(g)market information;
(h)Garage pricing;
(i)labour estimates; and
(j)other relevant data.
21.4.2Any indication that a Quote appears high, low, reasonable, unusual or incomplete is an estimate and does not constitute a determination that the Garage's Quote is correct or incorrect.
21.5.1Users remain responsible for deciding whether to:
(a)accept a Quote;
(b)authorise repairs;
(c)seek a second opinion;
(d)drive a Vehicle;
(e)replace parts; or
(f)rely upon information provided through the Platform.
21.5.2Where a Vehicle may have a safety-critical fault, Users should obtain advice from an appropriately qualified automotive professional.
22.1.1Users may upload or submit Content including:
(a)photographs;

(c)documents;
(d)reviews;
(e)messages;
(f)Vehicle information;
(g)repair descriptions; and
(h)other materials.
22.1.2Users retain ownership of intellectual property rights they hold in their Content.
22.2.1By submitting Content, the User grants BoxBox a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt, display and otherwise use that Content to the extent reasonably necessary to:
(a)operate the Platform;
(b)facilitate Bookings;
(c)provide customer support;
(d)investigate disputes;
(e)prevent fraud;
(f)improve Platform functionality; and
(g)develop and improve BoxBox services.
22.2.2Where Content contains personal information, its processing remains subject to the BoxBox Privacy Policy and applicable data protection law.
22.2.3Users represent that they have the necessary rights and permissions to upload Content submitted through their Account.
23.1.1BoxBox may enable Users to maintain digital Vehicle records.
23.1.2These records may include:
(a)mileage;
(b)maintenance history;
(c)Garage visits;
(d)invoices;
(e)photographs;
(f)repair records;
(g)parts replacements;
(h)inspection results; and
(i)service recommendations.
23.2.1Users acknowledge that these records may depend upon information supplied by Users and Garages.
23.2.2BoxBox does not guarantee that a digital service history is complete or equivalent to a manufacturer-approved service history.
23.2.3Users should retain original documentation where required for warranty, insurance, resale or legal purposes.
24.1.1Users must use the Platform lawfully and responsibly.
24.1.2A User must not:
(a)use the Platform for unlawful purposes;
(b)provide false or misleading information;
(c)impersonate another person;
(d)attempt to gain unauthorised access to the Platform;
(e)interfere with Platform security;

(g)scrape or systematically extract Platform data without permission;
(h)reverse engineer Platform software except where expressly permitted by law;
(i)use automated systems to create fraudulent activity;
(j)harass Garages, Users or BoxBox personnel;
(k)submit fraudulent payment information;
(l)manipulate reviews or ratings;
(m)infringe intellectual property rights;
(n)upload unlawful Content; or
(o)otherwise use the Platform in a manner reasonably likely to cause harm to BoxBox, another User, a Garage or any third party.
25.1.1Users must not use information obtained through the Platform primarily to circumvent BoxBox's booking or payment processes in relation to a transaction introduced through BoxBox.
25.1.2For example, Users must not deliberately arrange with a Garage to move a Booking off-platform for the principal purpose of avoiding applicable Platform fees or controls.
25.2.1BoxBox may restrict or suspend Accounts where it reasonably determines that systematic circumvention has occurred.
25.2.2This provision does not prevent Users from maintaining legitimate independent relationships with automotive service providers.
26.1.1All intellectual property rights in the Platform, excluding User Content and third-party materials, belong to BoxBox or its licensors.
26.1.2This includes rights in:
(a)software;
(b)source code;
(c)databases;
(d)algorithms;
(e)interfaces;
(f)Platform design;
(g)graphics;
(h)logos;
(i)trademarks;
(j)text;
(k)scoring methodologies;
(l)recommendation systems; and
(m)proprietary data compilations.
26.2.1Subject to these Terms, BoxBox grants Users a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for its intended purposes.
26.2.2No rights are transferred to Users except those expressly granted under these Terms.
27.1.1The BoxBox name, logo and associated brand elements are trademarks or proprietary assets of BoxBox.
27.1.2Users may not use BoxBox branding without prior written permission except where such use is expressly enabled by the Platform or permitted by law.

(g)identity verification services; and
(h)communications providers.
28.2.1Third-party services may be subject to separate terms and privacy policies.
28.2.2BoxBox is not responsible for the acts or omissions of independent third-party service providers except to the extent responsibility cannot lawfully be excluded.
29.1.1BoxBox may offer:
(a)promotional codes;
(b)referral credits;
(c)discounts;
(d)introductory offers; or
(e)other promotional benefits.
29.2.1Promotions may be subject to additional terms.
29.2.2Unless otherwise stated:
(a)promotions have no cash value;
(b)they may not be transferred;
(c)they may expire;
(d)they may be limited to one use;
(e)they may be restricted to particular Users, Garages or Services; and
(f)they may not be combined with other promotions.
29.2.3BoxBox may withdraw or cancel a promotional benefit where it reasonably suspects fraud, misuse or an obvious pricing or technical error.
30.1.1BoxBox aims to provide a reliable Platform but does not guarantee uninterrupted or error-free availability.
30.1.2Access may be interrupted because of:
(a)maintenance;
(b)software updates;
(c)infrastructure failures;
(d)telecommunications failures;
(e)cybersecurity incidents;
(f)third-party service outages; or
(g)circumstances beyond BoxBox's reasonable control.
30.2.1BoxBox may modify, replace or discontinue Platform functionality where reasonably necessary.
30.2.2Where a material change adversely affects an existing paid service, BoxBox will take reasonable steps to notify affected Users.
31.1.1BoxBox may suspend, restrict or terminate a User's access to all or part of the Platform where BoxBox reasonably believes that:
(a)the User has breached these Terms;
(b)the User has engaged in fraudulent or unlawful activity;
(c)the User has provided false or misleading information;
(d)the User has failed to make amounts properly due;
(e)the User has abused or threatened a Garage, another User or BoxBox personnel;
(f)the User has manipulated or attempted to manipulate reviews, ratings, promotions or Platform functionality;
(g)the Account has been compromised;
(h)continued access presents a security, legal, regulatory or reputational risk;
(i)suspension is necessary to protect another User, a Garage or BoxBox; or
(j)BoxBox is required to do so by law, court order or a competent authority.
31.1.2Where reasonably practicable, BoxBox will notify the User of the suspension or termination and, where appropriate, provide an opportunity to remedy the relevant breach.
31.1.3BoxBox may suspend access immediately where reasonably necessary to prevent fraud, protect safety or security, comply with law or prevent material harm.
31.2.1A User may stop using the Platform at any time and may request closure of their Account through the Platform or by contacting BoxBox.
31.2.2Account closure does not:
(a)cancel obligations arising from existing Bookings;
(b)extinguish amounts already due;

32.2.3BoxBox's involvement in a dispute does not make BoxBox responsible for the underlying automotive services.
32.3.1Where a dispute concerns technical workmanship, the parties may be asked to obtain an assessment from an appropriately qualified independent automotive professional.
32.3.2Responsibility for the cost of such an assessment will depend upon the circumstances and any agreement reached between the User and Garage.
32.4.1Unless BoxBox expressly offers a formal dispute resolution programme, BoxBox is not required to adjudicate disputes between Users and Garages or determine legal liability.
32.4.2Nothing in this section prevents a User from exercising rights available under applicable consumer protection legislation.
33.1.1Nothing in these Terms excludes, restricts or modifies any statutory right, remedy, guarantee or protection that cannot lawfully be excluded or restricted.
33.1.2Where a User is a consumer, the User may have rights under applicable consumer protection legislation in relation to services purchased through the Platform.
33.1.3These rights may apply independently of warranties offered by a Garage.
33.1.4Where any provision of these Terms conflicts with a mandatory consumer protection requirement, the mandatory requirement will prevail to the extent of the conflict.
34.1.1BoxBox provides the Platform as a marketplace and technology service.
34.1.2Except where expressly stated otherwise, BoxBox does not itself provide automotive repair, maintenance, inspection, recovery or other Garage services. Nothing in these Terms excludes any responsibility or obligation imposed directly on BoxBox by applicable law, including where BoxBox is treated as a provider, digital trader, e-commerce provider or other regulated person under applicable legislation.
34.2.1BoxBox does not warrant or guarantee:

(g)the accuracy of a Garage's Quote; or
(h)the outcome of any repair.
34.2.2The relevant Garage remains responsible for the automotive services it provides.
BoxBox takes reasonable steps to maintain useful and accurate Garage information but does not guarantee that every Garage profile, certification, facility description, price or other item of information will always be complete, accurate or current.
34.4.1Information provided through the Platform is intended to assist Users in making decisions.
34.4.2Except where expressly stated otherwise, Platform information does not constitute professional automotive, engineering, financial, insurance or legal advice.
34.5.1BoxBox may provide pricing comparisons, indicative market prices or other information intended to help Users assess Quotes.
34.5.2BoxBox does not guarantee that use of the Platform will result in the lowest available price or any particular financial saving.
Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.
35.2.1To the maximum extent permitted by applicable law, BoxBox is not liable for loss or damage arising directly from acts or omissions of an independent Garage, including:

35.3.2This limitation does not apply to the extent prohibited by applicable consumer protection law.
BoxBox is not liable for losses resulting solely from temporary Platform interruptions caused by maintenance, third-party infrastructure failures, telecommunications outages or circumstances outside BoxBox's reasonable control, except where liability cannot lawfully be excluded.
35.5.1To the maximum extent permitted by applicable law, BoxBox's aggregate liability to a User arising from or in connection with the Platform or these Terms will not exceed the greater of:
(a)the total fees paid directly to BoxBox by that User during the twelve months preceding the event giving rise to the claim; and
(b)AED 1,000.
35.5.2The limitation in this section does not apply to liability that cannot lawfully be limited.
Users must take reasonable steps to mitigate losses arising from any matter connected with the Platform.

This indemnity does not apply to the extent that a loss was caused by BoxBox's own breach, negligence or other act or omission for which liability cannot lawfully be excluded.
38.1.1BoxBox processes personal information in accordance with the BoxBox Privacy Policy and applicable data protection legislation.
38.1.2The Privacy Policy explains:

40.2.2Users are responsible for keeping their contact information current.
41.1.1BoxBox will not be responsible for failure or delay in performing obligations where that failure or delay results from circumstances beyond the affected party's reasonable control.
41.1.2Such circumstances may include:
(a)natural disasters;
(b)extreme weather;
(c)fire;
(d)flood;
(e)epidemic or pandemic;

(n)cyberattacks;
(o)labour disputes;
(p)supply-chain disruption; or
(q)shortages of automotive parts.
41.1.3This section does not excuse payment obligations that arose before the relevant event.
42.1.1BoxBox may amend these Terms from time to time to reflect:
(a)changes to the Platform;

(c)changes in law;
(d)regulatory requirements;

Users may not assign or transfer their rights or obligations under these Terms without BoxBox's prior written consent.
43.2.1BoxBox may assign or transfer its rights and obligations:
(a)to an affiliate;
(b)as part of a corporate restructuring;
(c)in connection with an investment;
(d)in connection with a merger or acquisition; or
(e)in connection with the sale of all or substantially all of the relevant business or assets,
provided that such transfer does not materially reduce mandatory consumer protections applicable to the User.
Nothing in these Terms creates a partnership, joint venture, employment relationship or agency relationship between BoxBox and a User. Except where expressly stated otherwise, Garages are independent businesses and are not employees, agents or representatives of BoxBox. No Garage has authority to enter into obligations on behalf of BoxBox.
Except where expressly stated otherwise, no person other than the User and BoxBox has any right to enforce these Terms. This provision does not affect any right or remedy available to a third party independently of these Terms.
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable where legally permissible. If modification is not possible, the relevant provision will be severed. The remaining provisions will continue in full force and effect.
Failure or delay by BoxBox in exercising a right or remedy does not constitute a waiver of that right or remedy. A waiver in relation to one breach does not constitute a waiver of any subsequent breach.
These Terms and the BoxBox Privacy Policy constitute the agreement between BoxBox and the User concerning the Platform. A Booking may also be subject to separate terms between the User and the relevant Garage. Those Garage terms do not form part of the agreement between BoxBox and the User unless BoxBox expressly states otherwise. Nothing in this section excludes liability for fraud or fraudulent misrepresentation.
Unless the context requires otherwise:
If these Terms are translated into another language and there is any inconsistency between versions, the English version will prevail to the extent permitted by applicable law.

Subject to any mandatory rights available to consumers under applicable law, the courts of Dubai shall have jurisdiction to determine disputes arising from or in connection with these Terms or use of the Platform. Nothing in this section prevents a Consumer from bringing a claim before another court or competent authority where that right cannot lawfully be excluded.
